These Terms of Use (the “Terms”) govern your use of and access to https://birdsongbespoke.com and its sub-domains, social media accounts, and affiliated sites (the “Sites”), including but not limited to Birdsong Bespoke, LLC’s (“Birdsong Bespoke” “my”, “me” or “I”) pages and accounts on Instagram®, Facebook®, Pinterest®, and TikTok®. Please read both these Terms and my Privacy Policy carefully, which is incorporated into these Terms. By using any or all of the Sites, you accept and agree to be bound by these Terms. If you do not want to agree to be bound by these Terms, do not use the Sites. I may modify these Terms from time to time, and any modifications will be effective immediately when I post them. You are responsible for reviewing any modified terms. Your continued use of a Site following any changes means you accept and agree to any changes.
Site Content
Birdsong Bespoke, LLC exclusively owns and controls the Sites, which provides information about my products and services and may, from time to time, provide access to educational materials pertaining to a variety of luxury paper goods, wedding stationery, and calligraphy services. The use of or access to any or all of the Sites does not, standing alone, create any sort of representation or future promise. The unauthorized reproduction, use of, or theft of any content, written, photographic, or otherwise, is expressly prohibited and will be prosecuted to the maximum extent allowed by law. I reserve all right to remove any content or link posted to any Site that is illegal, obscene, offensive, or for any reason at all at my sole discretion.
Intellectual Property
Unless explicitly stated otherwise, as between you and Birdsong Bespoke, Birdsong Bespoke owns all right, title, and interest in and to the Sites, including, without limitation, graphics, site content, design, organization, compilation and other matters related to or included on the Sites. My name, Birdsong Bespoke, LLC and all related names, product and service names, logos, slogans, and designs are my trademarks and you may not use these marks without my prior written permission. All other names, logos, product and service names, designs and slogans on the Sites are the trademarks of their respective owners and should not be used without those respective owners’ permission.
Third Party Rights
Content and materials posted to the Site may be the copyrighted content of others (“Third Party Content”) that is used by Birdsong Bespoke either by permission or under Section 107 of the Copyright Act as “fair use” for purposes such as education and research. I respect the intellectual property of others and ask that you do the same. Users must obtain permission from the owners of any Third-Party Content before copying, distributing or otherwise using those materials. Except as otherwise expressly permitted under copyright law, no copying, redistribution, retransmission, publication, or commercial exploitation of downloaded material will be permitted without the express permission of the copyright owner.
If you believe that your work has been copied on one or more of the Sites in a way that constitutes copyright infringement or otherwise violates your intellectual property rights, please contact a copyright attorney.
Linking To Our Sites
Anyone linking to the Sites must comply with all applicable laws and must not: (i) misrepresent its relationship with Birdsong Bespoke; (ii) present false or misleading information about Birdsong Bespoke; or (iii) contain content that is reasonably considered profanity, offensive, defamatory, vulgar, or unlawful. I reserve all right to remove any content or link posted to any Site that is illegal, obscene, offensive, or for any reason at all at my sole discretion.

I may at times include advertisements on the Sites. Your correspondence or business dealings with, or participation in promotions of, advertisers found on or through the Sites are solely between you and such advertiser. Any opinions, advice, statements, services, offers, or other information or content expressed or made available by advertisers, including information providers, or any other end users are those of the respective author(s) and not my own. You agree that I shall not be responsible or liable for any loss or damage of any sort incurred as a result of any such dealings or as the result of the presence of such advertisers. Any affiliate links that I link on the Sites will be clearly marked; however, I encourage you to reach out to me with any questions you may have regarding affiliate links.

Choice Of Law & Venue
These Terms are governed by the laws of the State of Colorado without regard to any conflict of laws. For any dispute regarding these Terms or the Sites, you agree to submit to the personal and exclusive jurisdiction and venue of the federal and state courts located in Lafayette, Colorado.
Design & Content
Each collection was thoughtfully designed to ensure the client receives a beautifully curated set. Wording, locations, dates, times, and other content will be customized for you and your day. If any major changes to the design are requested, we will determine the increased cost on a per-case basis.
It is of utmost importance that you carefully check your proof(s) for spelling errors or inaccuracies. Once you give your final approval for printing, we cannot make any amendments.
Availability
We cannot guarantee that the products we source from outside suppliers will be available at all times. If your preferences are not available, we will guide you through suitable alternatives.
Our services are available on a first-come, first-served basis and we may become fully booked for your desired season. We recommend submitting your inquiry as early as possible. In the event we are not available for your project, we are happy to provide you with the names of other talented stationers. In the event you have already submitted payment and we are unable to fulfill all or part of your order, a refund will be given for the portion of the work which cannot be fulfilled.
Variances
Calligraphy. Calligraphy is a beautiful, hand-crafted art. As such, please note there may be slight variances in every application.
Paper. Handmade paper is also hand-crafted and each piece will be unique in texture, weight, size, and color, yet will still look and feel like a cohesive collection. This is the charming nature of a handmade product.
Printing. Digital printing is very precise and is the standard most of us are familiar with. Letterpress printing and blind press printing are less precise, yet gorgeous methods. Please note there may be slight variances in placement of text, images, and designs when choosing from these printing options.
Screen vs. Print
Screens can be tricky when it comes to colors and textures — it all depends on your individual screen settings. We strive to represent all our materials and products as accurately as possible but please note there may be slight variances in the final completed product.
Proofing
Depending on the size & complexity of your order, we will provide at least 2 complimentary proofs for your approval prior to printing — one for initial placement & spelling, and one final proof. Please check everything carefully and thoroughly: spelling/content, sizing, ink colors, paper colors, font size. We cannot make any amendments once the final proof has been approved and final payment has been made.
In the event there is an error on any of the hand-written items, please contact us immediately. If the mistake is ours, we will re-write the items in question and ship them at no cost to you. Otherwise, our normal calligraphy rate will be charged along with shipping costs.
Timing
Most items will take approximately 4-6 weeks from final order date to shipping date. This largely depends on any customization and embellishments. Prior to placing your final order, we will contact you. In the event we need to amend this expected time frame, we will notify you immediately.
Time is of the essence and your prompt response is very important to ensure we capture your vision just right. Please note that additional revision rounds and delays in client feedback may affect the time frame.
We are not responsible for delays related to shipping.
Pricing & Payment
All pricing listed on our website is a starting baseline and does not include applicable taxes or shipping. Pricing will adjust based on your required item quantity and custom selections. You will be provided with a list of services and an invoice after our first consultation. We require a 50% non-refundable deposit to begin design. The remaining balance will be due upon approval of final design and before production begins. Once your order is ready to ship, you will be provided shipping information and associated costs. All pricing is in USD and is subject to change without notice.
Shipping
We will notify you of shipping information, costs, and time frames once production of your order is complete. Shipping costs are the sole responsibility of the client. We will always provide a tracking number with your order but we have no guarantee nor control over shipping times. We recommend placing your order as early as possible to avoid any stress due to shipping delays. We are not responsible for any delays, damages, or losses due to shipping.
If you require rush shipping, we will advise you on options and associated costs.
Publication & Crediting
If images of work created by Birdsong Bespoke are to be published either in print form or digitally, Birdsong Bespoke must be credited and notified prior to the publication.
Clients have the express right to keep, share, and display their physical collections. If the client, or a hired photographer, wishes to share photos of their collections on social media platforms, Birdsong Bespoke must be properly credited with the handle @birdsongbespoke.
We retain the right to publish images of all projects on our website and social media platforms. We will never share real addresses online. If the client has any issues concerning this, please notify us before submitting final payment.
Returns / Exchanges / Cancellations
Due to the custom, handmade nature of our products, we are not able to offer returns, exchanges, or refunds.

Privacy
